Terms

A public wall. Your words stay yours. The wall has to stay kind.

These Terms are the contract between you and us when you use One Million Hearts (onemillionhearts.co). They cover putting a heart on the wall, and paying to keep one forever. They include the Privacy page. If you don’t agree, don’t use the wall.

One Million Hearts is operated by Inoveb Ltd, a company registered in England and Wales (Companies House 10579627). VAT GB309553007. Registered office: 72 Badminton Road, London, SW12 8BL, United Kingdom. Email: hello@onemillionhearts.co.

The contract language is English. Complaints: email hello@onemillionhearts.co. If VAT applies, it is included in the total Stripe shows at checkout.

Who can use it

You must be at least 16 and able to enter a contract. If you pay, you confirm the card is yours to use.

The wall

One Million Hearts lets you put a short public note on a wall, to someone you love, or someone you miss. Main characteristics of what we offer:

  • A free heart stays on the wall for 30 days, then it leaves. No charge.
  • A forever heart is digital content: this heart, on this wall, with a number of its own, for as long as the project runs. Price $3, inclusive of applicable tax where Stripe calculates it that way. No delivery charge, no subscription, no extra distance-communication fee, no deposit.

Anyone can read what’s on the wall. A heart’s colour doesn’t stand for anything. Only forever hearts count toward one million. When the wall already has a million forever hearts, you cannot buy another. We may change how the wall looks, pause it, or stop it.

How a forever heart is bought

Write a note, sign in, then pay on Stripe. At checkout you agree to these Terms. While a note is waiting, you can keep changing it. After it is on the wall, you can change it once; the version already up stays until we approve the new one. Paying does not lock the text. The contract is formed when Stripe tells us payment succeeded. We don’t file the contract on a public register; keep your email receipt.

Payment keeps the note. If it is still waiting, it goes on the wall when we approve it. If it is already up, it stays as soon as you pay. By paying, you ask us to do that. If you want your money back, write to us. We’ll refund, even if the heart is already on the wall. If we cannot keep the heart (for example we reject it), we will refund.

Payment is card (and any other method Stripe shows you) in US dollars. There is no shipping. A forever heart appears on the wall after we approve the paid note. If you paid for a note that was already up, it stays as soon as payment succeeds. We may still hide it later if it breaks these Terms. We intend to keep forever hearts up for the life of the project. You can end your side by taking the heart down or erasing your account from My hearts. Taking it down doesn’t send the money back by itself. Within 14 days of payment, write to us and we’ll refund you.

Refunds

What you buy

$3 (inclusive of applicable tax at checkout) keeps one heart on the wall forever. It is digital content, supplied online in a browser. It is not a physical object, not a download, and not a subscription. There is no delivery charge and nothing to return by post.

Cooling-off

Online purchases of digital content usually come with a 14-day right to cancel, starting the day after you pay.

If you pay while the note is still waiting, it goes on the wall when we approve it. If it is already on the wall, it stays when payment succeeds. If you want your money back, email hello@onemillionhearts.co. We’ll refund, even if the forever heart is already on the wall. Say you want to cancel, and include the email you paid with. A heart link helps if you have one.

When we refund

Email hello@onemillionhearts.co and we will refund if:

  • You changed your mind, even if the forever heart is already on the wall.
  • We rejected the note and you don’t want to fix it and try again.
  • You were charged twice, charged in error, or charged and we couldn’t keep the heart.
  • We hid the note before it went up because it doesn’t fit these Terms, and you aren’t going to revise it.
  • The content is not of satisfactory quality, not fit for purpose, or not as described, and a refund is the fair remedy.

Tell us the email you paid with and, if you have it, a link and the approximate date. Refunds go back through Stripe to the original payment method. Once we agree, we send the money without undue delay and within 14 days. It can take several more working days to show on a statement. We don’t charge a fee to refund.

When we don’t

  • You took the heart down yourself, or erased your account. That doesn’t send the money back by itself. Within 14 days of payment, write to us and we’ll refund you.
  • We hid a heart that was already up because it broke these Terms.

If none of that fits, email hello@onemillionhearts.co. We’ll see what we can do.

What a forever heart is, technically

It is a page on this website, in a web browser, over the internet. There is no app, no download, and no DRM beyond the fact that we host it. You need a current browser and a connection. We don’t promise it will look identical on every device, or that a particular person will see it.

Your account

Leaving a heart means signing in with email, Google, Apple, or Facebook. You’re responsible for that sign-in and for what goes up under it. You can take your own heart down, or erase the account, from My hearts. If we have an email, we’ll send a code to that inbox before we erase it. If we don’t, you confirm it while signed in. Erasing drops your sign-in and takes your notes off the wall. Taking a paid heart down, or erasing the account, doesn’t send the money back by itself. Within 14 days of payment, write to us and we’ll refund you.

Your notes

You keep the copyright in what you write. By posting, you give us a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and share the note on the wall and in reasonable promotion of the project (including emails about your heart and social posts). That licence lasts for as long as the heart is meant to stay: 30 days for a free note, indefinitely for a forever heart, and for a reasonable archive after it comes down.

You promise the note is yours to post, that it doesn’t impersonate someone to cause harm, that it doesn’t include anyone else’s private information, and that it isn’t illegal. You are responsible for it. If a claim is made about your note, you will cooperate with us to deal with it.

The wall’s rules and illegal content

No hate, no harassment, no threats, no sexual content, no spam, no illegal content. We host notes that users write. We look at each note before it goes up, and we take down anything that should not stay. Paying does not guarantee a heart stays up. We can refuse, hide, or take down a note that breaks these Terms, that is illegal, or that we reasonably think will harm someone or the wall.

If you change your mind about a heart you wrote, you can take it down yourself from My hearts. If you see someone else’s heart that should not be here, including if you think it is against the law, use Report on that heart and we will look into it.

If a heart shouldn’t be here, including if you think it is illegal, use Report. We’ll look. We don’t promise a particular outcome or a particular speed. When we know a note is illegal, we take it down.

Your consumer rights

Nothing in these Terms takes away rights you have as a consumer that can’t be waived. Digital content must be of satisfactory quality, fit for purpose, and as described (Consumer Rights Act 2015). If it isn’t, you may have a right to repair, replacement, price reduction, or refund. We don’t offer a separate commercial guarantee or after-sales scheme beyond that and the refunds in these Terms.

Our limits

Other people’s notes are theirs. We don’t warrant that the site will always be up, that a note will be seen by a particular person, or that a forever heart will remain online if we have to close the project, though we intend to keep it.

We don’t exclude liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or for any liability that English law says we cannot limit. For everything else we can lawfully limit, our liability to you is capped at the amount you paid us for the heart in question (or, if you didn’t pay, £0).

Law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, without limiting any mandatory consumer rights you have where you live, including, if you live in Scotland or Northern Ireland, the right to sue there.

If a part of these Terms cannot be enforced, the rest still applies. We may update these Terms. The current version always lives on this page. If a change matters to an existing forever heart, we’ll still honour what you already bought.
